SLBA ToS and Skill Gaming presentation

ToS-SLBA-2On Saturday August 2nd, 2014, Agenda Faromet, an attorney specialising in privacy and Internet law operating out of San Francisco, and a member of the SL Bar Association, gave a dual presentation on the recent (July 2014) changes to Section 2.3 of Linden Lab’s Terms of Service and on the changes to the Lab’s policy on Skill Gaming in Second Life, which are due to come into effect from September 1st.

In all, the session ran to over an hour and a half, with Agenda initially covering the ToS Section 2.3 updates and dealing with questions relating to that, before moving on to the changes to the Skill gaming policy, and then addressing questions arising from that.

The following is a transcript of the core of the presentation, split into two parts for ease of reference. Audio recordings are provided, and there will hopefully be a video of proceedings in due course. With reference to the audio recordings provided here, please note:

  • The audio has been edited to remove pauses. repetition or asides, in order to better match the text transcript and allow those who wish to listen as they read
  • There has been no intentional altering of anything said during the presentation and Q&A session, nor has the context of the presentation or answers been altered in any way, other than questions asked in text being the placed within the transcript at the point where they are answered (when compared to chat logs of the event), again for better context

Terms of Service – presentation reminder

The formal announcement of the presentation

Just a quick reminder to all who are interested. As I blogged on July 24th, there will be a special presentation by Agenda Faromet on the July 2014 Terms of Service updates.

The presentation will take place on Saturday August 2nd, commencing at 10:00 SLT at the he SLBA courtroom.

Agenda is a real life attorney specialising in privacy and internet law operating out of San Francisco, and is a member of the SL Bar Association. She will be talking about both the changes made to Section 2.3 of the Terms of Service (the section relating to IP rights assigned to Linden Lab) and also on the changes to the Lab’s Skill Gaming Policy, which will be coming into effect as of September 1st, 2014 (having been previously scheduled for August 1st, 2014).

I hope to be able to record the meeting and provide a transcript through this blog for those who cannot attend.

In-world legal presentation on the recent updates to the Lab’s Terms of Service

I’ve received a press release from the SL Bar Association SLBA) announcing that Agenda Faromet, who in the physical world is an attorney specialising in privacy and internet law operating out of San Francisco, will be discussing the July 16th, 2014, changes to Section 2.3 of Linden Lab’s Terms of Service and also the recent changes to the Lab’s Skill Gaming policy.

The press release reads in part:

Linden Lab has recently announced changes to the Terms of Service associated with Second Life.  This change comes almost a year after the major controversy that erupted last year over a substantial change in section 2.3 of the agreement with users of Second Life, related to the license claimed by Linden Lab in works created by creators in-world.  Please join us for a lively discussion of the actual language changes from the prior terms of service.  Agenda will also discuss other changes implemented by Linden Lab, including the gaming policy.

The discussion is set to take place in the SLBA courtroom, starting at 10:00 SLT on August 2nd.

I hope to be able to attend the meeting and provide a transcript through this blog.

Copyright and fair use: an SLBA presentation transcript and audio

On Saturday March 1st, members of the Second Life Bar Association (SLBA) – real-life attorneys – sat down at the SLBA’s auditorium to discuss matters relating to copyright and fair use as they apply to US law and might impact content creators in Second Life.

In attendance were Agenda Faromet, who in real life is an attorney specialising in privacy and internet law operating out of San Francisco and Tim Faith (SL: Yoss Kamachi), a Maryland attorney with a strong background in IT and who deals with matters related to copyright, IP, trademark, etc.

In all, the session lasted just under 90 minutes, with initial presentations by Tim and Agenda, followed by joint coverage of a number of fair use cases in the US, prior to an open Q&A session.  An audio recording was made of the meeting, but suffered somewhat from microphones being overdriven.

What follows, is a transcript of that recording, which has been cleaned-up as far as possible, with unnecessary background noises, echoes, and pauses / repetitions edited out. For ease of reference, the transcript and audio have been divided into four sections:

Copyright and fair use for SL content creators: Agenda and Tim to reconvene

Update March 17th: The transcripts and audio of the presentations made by Tim and Agenda are now available.

On October 19th, 2013, Agenda Faromet and Tim Faith (SL: Yoss Kamachi), both real world lawyers, held an in-world legal panel (together with lawyer Juris Amat) to discuss the August 2013 changes to Linden Lab’s Terms of Service and matters of fair use, copyright and the Internet.

The event was well attended, and saw a host of questions asked, and not a few misconceptions dealt with.

Now Agenda and Tim are to reconvene for a meeting in a similar vein, marking their coverage of fair usage rights whichis also liable to be of interest to SL content creators (this particular meeting last having been held in February 2013).  This will take place at the Justitia Legal Resource Village from 10:00 SLT on Saturday, March 1st.

Agenda comments on the meeting, saying:

We did this last year and it was really successful, so Tim and I are doing it again this year. Are you interested in learning more about what we mean when we talk about “fair use”? Would you like to hear some actual lawyers talk about what it really means, what the current state of the law is, and how it applies to content creation and use in SL?

Of course you would.

So if you’re still confused or concerned about things like the Terms of Service, IP rights and fair use, make a note in your diary and pop along!

ToS changes: Legal panel discussion transcripts

On Saturday October 19th, a panel of legal experts  – real-life attorneys – sat down at the Rose Theatre, Angel Manor in Second Life to discuss the August 15th changes to the Second Life Terms of Service, address questions on the matter and remove some of the FUD which has built-up around the subject.

In attendance were Agenda Faromet, who in real life is an attorney specialising in privacy and internet law operating out of San Francisco, Tim Faith (SL: Yoss Kamachi), a Maryland attorney with a strong background in IT and who deals with matters related to copyright, IP, trademark, etc., and Juris Amat, a Massachusetts bar member who runs the Virtual Intellectual Property Organisation (VIPO). All three are members of the SL Bar Association, based in-world at Justitia.

In all, the session lasted just under three hours, with initial presentations by Agenda Faromet and Tim Faith (Juris Amat had difficulties attending the first part of the session). Tis was followed by a question-and-answer session moderated by Maxwell Graf, with Kylie Sabra relaying Juris Amat’s replies via voice.

For ease of reference, the transcripts are broken down into seven parts, as listed below. Each one includes the audio recording I provided in my original report on the meeting.
